Terms & Conditions — ereisen AG / AlpHoriZen Ltd

Governing Law: Switzerland

 

1. Contracting Parties
These Terms & Conditions (“Terms”) govern all travel, wellness, and experiential services (“Services”) provided by:

ereisen AG, Switzerland and/or AlpHoriZen Ltd, operating as the international service entity for global clients.

“You” refers to the contracting client and all participants included in the booking. All agreements are governed exclusively by Swiss substantive law, with the courts of Zug, Switzerland having exclusive jurisdiction.

 

2. Formation of Contract
A binding contract is formed when:
• You accept our written proposal
• You pay the required deposit
• We issue written confirmation
All quotations are non-binding until confirmed in writing.

 

3. Deposits, Payments & Pricing

3.1 Non-Refundable Design Deposit
A non-refundable planning & design deposit is required before any itinerary development begins. This covers advisory time, research, wellness curation, and partner negotiations.


3.2 Final Payment
Full payment is due immediately upon approval of the final itinerary.


3.3 Payment Conditions
• Payments must be received net of all bank charges
• Payments must be made in the invoice currency
• Exchange rate fluctuations may affect supplier costs


3.4 Additional Costs
Any additional services requested during the trip must be paid immediately unless otherwise agreed.

 

4. Insurance Requirement
All participants must hold comprehensive travel insurance covering:
• Medical emergencies
• Repatriation
• Search & rescue (if applicable)
• Cancellation & curtailment
• Personal belongings
Proof of insurance must be provided prior to departure.

 

5. Changes or Cancellation by You
5.1 Changes

We will attempt to accommodate changes, but availability cannot be guaranteed.

Additional costs may apply.

 

5.2 Cancellation Fees
Cancellations must be submitted in writing. The following fees apply:
90+ days: Loss of deposit + non-recoverable supplier costs
60–89 days: 30% of total trip cost + non-recoverable costs
• 30–59 days: 60% of total trip cost + non-recoverable costs
0–29 days: 100% of total trip cost (minus unpaid supplier costs we are not obligated to pay)

 

6. Changes or Cancellation by the Company
We may modify or cancel arrangements due to circumstances beyond our control, including:
• Supplier failure
• Safety concerns
• Government restrictions
• Natural events
If changes significantly alter your trip, you may cancel and receive a refund of recoverable amounts.

 

7. Force Majeure

We are not liable for failure to perform obligations due to events outside our reasonable control, including:
• Natural disasters
• Epidemics or pandemics
• Political instability
• Government restrictions
• Extreme weather
• Strikes
No compensation is payable in such circumstances.

 

8. Client Responsibilities & Acceptance of Risk
By booking with us, you acknowledge:
• Travel may involve risks, including remote locations, variable weather, physical
activities, and differing safety standards
• You must follow instructions of guides, wellness practitioners, and local partners
• You must disclose any medical conditions that may affect participation
• You are responsible for valid passports, visas, and health documentation
We may decline participation if a guest is unfit to travel or poses a safety risk.

 

9. Liability
9.1 Limitation
Our liability is limited to cases of gross negligence or intentional misconduct, in accordance with Swiss law.
We are not liable for:
• Acts or omissions of third-party suppliers
• Illness, injury, or death resulting from inherent travel risks
• Loss or damage to personal property
• Consequential or indirect losses
• Services not explicitly included in our written agreement


9.2 Third-Party Providers

Independent suppliers (hotels, wellness practitioners, transport providers, guides) operate under their own terms & conditions.

 

10. Passports, Visas & Health Requirements
You are responsible for:
• Ensuring passport validity
• Obtaining visas
• Meeting health entry requirements
• Understanding future travel implications of visiting certain destinations
We accept no liability for losses arising from failure to comply.

 

11. Data Protection & Privacy
We process personal data in accordance with:
• Swiss Federal Act on Data Protection (FADP)
• Our internal Privacy Policy
Data may be shared with trusted partners strictly for itinerary delivery.

 

12. Compliance, Due Diligence & Sanctions
To comply with Swiss and international regulations, we may require:
• Passport copies
• Identity verification
• Beneficial ownership information (for corporate clients)
We may refuse service if information is incomplete or if a guest appears on sanctions
lists.

 

13. Intellectual Property, Confidentiality & Usage Restrictions
13.1 Ownership
All itineraries, proposals, wellness programs, concepts, designs, texts, images, and any other materials provided by ereisen AG / AlpHoriZen Ltd (“Company Materials”) are the exclusive property of the Company.


13.2 Prohibition on Copying & Distribution
You agree that:

Unauthorised copying, reproduction, distribution, disclosure, or use of Company Materials is strictly prohibited
• Materials may not be shared with third parties without written permission
• Materials may not be used to recreate similar services or for competitive purposes
• All documents are provided solely for personal use in connection with your booked experience
Any breach constitutes a violation of Swiss intellectual property law (including the Swiss Copyright Act, URG).


13.3 Registered Trademarks
The ereisen AG logo and the AlpHoriZen logo are registered and trademarked in Switzerland. Any unauthorised use, reproduction, or modification of these trademarks is strictly prohibited and may result in legal action.

 

14. Excursions & Independent Activities
Activities booked independently by you are not part of our contract. We are not responsible for any issues arising from such arrangements.

 

15. Governing Law & Jurisdiction
These Terms are governed exclusively by Swiss law. The courts of Zug, Switzerland have exclusive jurisdiction.
